The following principles are meant to apply to all parts of the act:

  • the welfare of the child is paramount
  • there should be a minimal delay in proceedings pertaining to children; delay and uncertainty will be detrimental to a child
  • court orders should only made if they are of benefit over not making an order
  • courts should consult a welfare checklist
