The Mental Health Act deals with the provision of treatment to patients who may be incapable of giving informed consent or who may refuse to do so.

These provisions do not apply to those detained under Section 4, under short-term powers or when remanded for report.

A distinction is made between consent for medication or ECT, and consent for surgical operations or proceedures with more lasting effects.
